Review of the NZTA Compliance Response Framework (2026)
DTK and Associates reviewed the NZTA Compliance Response Framework for the Director of Land Transport, as part of the Director’s programme of assurance reviews. The review used a literature review, a focus group, Q methodology with 35 participants from inside NZTA and the regulated sector, and follow-up interviews, and identified six distinct perspectives on the framework that together account for 69 percent of the variance. We found that the framework has broad support as an architectural document, but that the second-tier documentation needed to give it practical effect in each regulatory subsystem is largely incomplete, and that the system tends to default to defensive regulation and to go silent when communication matters most. We also found that the administrative burden regulated parties carry reaches well beyond compliance costs, with five dimensions: direct compliance costs, learning costs, psychological costs, friction costs and design costs. Rather than make formal recommendations, the review set out three considerations for the Director: building the regulatory practice framework beneath the framework while simplifying the rules and guidance above it, commissioning a structured analysis of administrative burden, and establishing a structured, calendarised programme of regulatory dialogue with the sector.
